You should be aware of e-discovery, or discovery of electronically stored information (ESI). Many documents now are maintained electronically. Simple ESI includes emails, Word, and Excel. Complex ESI includes databases, legacy systems, and intranet sites. Newer ESI includes smart devices and social media. You’ll need to work with both your attorney and IT.
